Former Barcelona and Brazil defender Dani Alves has been forced to remain in jail after being unable to pay his €1million (£860,000) bail.

Alves, 40, was found guilty of raping a woman in a Barcelona nightclub in the early hours of December 31, 2022 following his three-day trial last month, and has been held at Brians 2 Prison in Barcelona since January 2023.

He was sentenced to four-and-a-half years in prison for rape, as well as being ordered to pay a €150,000 (£128,000) fine, and banned from approaching the victim for nine-and-a-half years.

His lawyer, Ines Guardiola, filed an appeal against the verdict, and Alves was last week granted bail by a Barcelona court once he pays the £860,000 fee.

The Barcelona based newspaper Sport reported that Alves was forced to remain in prison over the weekend, after the former Brazilian international was unable to pay his bail.

Reports had initially claimed the father of Brazilian star Neymar would help to fund Alves’ bail, but he issued a statement denying the claims.

‘For us, for my family, this matter is over. Full stop,’ the statement read.

‘With the Spanish court ruling for his conviction, there’s speculation and an attempt to associate my name and my son’s to a matter that is not within our reach any longer.’

Alves’ lawyer said the Brazilian has two bank accounts in Spain, one with no balance and the other with €51,000 (£44,000), with a judicial seizure of €50,000 (£43,000).

Guardiola claimed last year that her client ‘is broke’ and has a ‘negative bank balance of £17,000’, despite reportedly once having a fortune of £47million.

Sport reported that Alves accounts in Brazil have also been blocked due to problems with his ex-wife Dinorah Santana.

Alves, however, is expected to receive €9.2 million (£7.9 million) after his tax lawyer Fernando Mota won four cases against Spain’s tax agency.

The hearing to determine Alves bail had noted the 40-year-old was set to receive ‘a large sum of money’ back from the treasury, but he has not yet received the funds.

His ex-wife Santana is among those to have spoken out against Alves being granted release from prison on bail.

‘There are times when you will have to share the table with Judas, without that taking away your peace. Well, me today,’ she wrote on Instagram.

Santana, the mother of his two children, had initially said she was standing by him and insisted he would never commit the crime he was arrested for.

The sports agent later claimed she felt she had been ‘used’ and told Spanish television ‘For me, he doesn’t exist. For me, he has died.’

Prosecutors for Alves’ case had called for him to receive a nine-year sentence, and argued that he should not be allowed bail due to concerns he could flee Spain to return to Brazil.

However, he was handed only half the jail time they wanted, and has now been freed from prison, pending the outcome of his appeal. 

Alves has always maintained his innocence, insisting that his sexual encounter with the young woman in the nightclub bathroom was consensual.

However, he was sacked by Mexican club UNAM Pumas following his arrest 14 months ago.

Alves spent eight years at Barcelona between 2008 and 2016, winning six LaLiga titles and the Champions League three times.

He was removed from their official list of club legends after being found guilty of rape.

However, the club performed a U-turn just days later and put him back on their list in a decision that appeared to be celebrated by his ex-wife, Sanz.

She wrote ‘To Caesar what belongs to Caesar’ on her Instagram story alongside a picture of Alves celebrating in a Barcelona shirt.

The following week, Alves’ brother blasted fake claims from a prankster that he former full back had taken his own life in prison.

Alves also won league titles with Juventus and PSG, and earned 126 international caps for Brazil.

He won the Copa America and Confederations Cup twice each with the South American nation.
