New York Governor Kathy Hochul continued her U-turn on the crisis at the border as she said that the state should consider deporting a group of migrants who went free on bail after attacking two cops in Times Square.
Four men were all charged with Assault on a Police Officer, Gang Assault, Obstructing Governmental Administration and Disorderly Conduct but were released without bail.
A fifth, Jhoan Boada, 22, was arrested Monday night and charged with Attempted Assault on a Police Officer and Gang Assault.
Democrat Governor Hochul, speaking at an event Wednesday, was asked whether the migrants and offenders like them should face deportation.
‘I think that’s actually something that should be looked at,’ Hochul answered.

‘I mean, if someone commits a crime against a police officer in the state of New York and they’re not here legally, it’s definitely worth checking into,’ she said.
‘These are law enforcement officers who should never under any circumstances be subjected to physical assault,’ Hochul added. ‘It’s wrong on all accounts and I’m looking to judges and prosecutors to do the right thing.’
Her words followed up Republican elected officials releasing statements irate about the attacks.
‘The city is refusing to cooperate with federal detainer and deportation requests from Immigration and Customs Enforcement,’ said Nicole Malliotakis, a Republican Congresswoman who represents Staten Island.
‘Republicans, Democrats & Independents should, at the very least, be able to agree that migrants who assault our police or commit crimes in our country should be deported immediately and have any future immigration application denied,’ she added.
NYPD Chief of Patrol John Chell added that the attack was ‘reprehensible’ and said the migrants belonged in jail.
The incident began at around 8:30 p.m. Saturday night on West 42nd Street, as the pair of cops told the violent quartet men to get moving.
That’s when a fight started to break out between a suspect in a yellow sweatshirt and the police officers.

According to the NYPD, the migrants then started to attack the officers, kicking them in the head and body while the two officers try to pin down one of the other men, tearing off his sweatshirt.
The migrants then ran away, leaving the unidentified police officers on the ground while they made their getaway east on 42nd Street toward Seventh Avenue.
At around 10:44 p.m. that night, four of them – Darwin Andres Gomez Izquiel, 19, Kelvin Servat Arocha, 19, Juarez Wilson, 21, and Yorman Reveron, 24 – were arrested.
They were all charged with Assault on a Police Officer, Gang Assault, Obstructing Governmental Administration and Disorderly Conduct but were released without bail.
Jhoan Boada, 22, was arrested Monday night and charged with Attempted Assault on a Police Officer and Gang Assault.
He was seen being perp walked into Manhattan Criminal Court that night.
Three of the men – Izquiel, Arocha and Wilson, 21 – were released on recognizance, meaning they were freed from custody without bail while their case is pending.
Reveron, 24, was granted supervised release without bail.

On Wednesday evening, Jhoan Boada was also released without bail because he has no criminal history.
But it is understood the DA’s office is now investigating additional footage they did not have when the asylum seekers were arraigned and released.
Investigators are believed to be using new information and witness accounts to determine specific role of each defendant in the attack, which occurred on Saturday.
The DA’s spokesperson said: ‘Violence against police officers is never acceptable.
‘It is paramount that we conclusively identified each defendant and specify each participant’s role in the incident.
‘Every defendant charged so far is facing felony charges that carry a penalty of up to seven years.
Reveron, the eldest of the men arrested, already has two open cases for assault and robbery in Manhattan.
A Nordstrom Rack employee had caught him attempting to swipe an item worth $130 in November before he allegedly ‘pushed, punched and bit’ them.
He also allegedly punched a loss prevention officer at the famous Herald Square Macy’s while trying to commit a robbery with two other suspects.
New York has come under fire for its progressive laws aimed at stopping people who can’t afford to make bail languish in prison for months on end.
Critics say it has led to a spike in violent criminals being freed straight back onto the streets – and emboldened them to reoffend, knowing there’ll be few consequences.

Hochul once welcomed asylum seekers with ‘open arms’ and pledged to house them but is now starting to migrants to ‘go elsewhere’ because the city is at its limit.
The Democrat addressed the migrant crisis in September, warning that asylum seekers who arrive in New York City will not be housed in hotel rooms as they have been in the past.
‘We have to get the word out, that when you come to New York, you’re not going to have more hotel rooms, we don’t have capacity,’ Hochul said on CNN. ‘So we have to also message properly that we’re at a limit – if you’re going to leave your country, go somewhere else.’
It’s a stunning reversal from her statements in December 2021, when she promised to house and protect asylum seekers – before thousands of migrants began arriving every month from Sothern border states. More than 113,000 migrants have arrived in the city since last Spring.
‘As you know, the Statue of Liberty is inscribed. It says, give me your tired, your poor, your huddled masses, yearning to be free,’ Hochul previously said. ‘You’re welcome with open arms and we’ll work to keep you safe… We’ll not only house you, but we’ll protect you.’
The city has a legal obligation to give shelter to those who make their way there, and mayor Eric Adams has desperately turned to a variety of city landmarks such as hotels, makeshift shelters and temporary housing as short-term solutions.
The attack comes as New York City struggles under the weight of tens of thousands of migrants in need of places to stay and other accommodations.
In 2023 alone, the city dealt with the arrival of more than 100,000 migrants.
New York City Mayor Eric Adams has pleaded for state and federal aid as it is estimated the migrant crisis will cost the city $12billion over the next three years – a number the Hochul administration is likely attempting to offset slightly with the new working plan.
New York is a Right to Shelter state and is required to house the asylum seekers but shelters have filled up at an astronomical rate.
In Manhattan, a number of landmark hotels have been turned into makeshift shelters and temporary housing.
